  1. INFORMATION TO THE USER

In accordance with the provisions of Organic Law 15/1999 on the Protection of Personal Data, we advise you that the information you provide in this form will be included in a personal data file, which is the responsibility of Fabricación Industrial de Calor HR, S.L. (hereinafter, “FAINCA HR”), with registered address at CALLE SAN FRANCISCO, 83, 2ºIZQUIERDA, 14900 LUCENA (CORDOBA), SPAIN. These files are intended for the management of users of the website, management of the services offered through this website and, where appropriate, management, development and fulfillment of the relationship established between FAINCA HR and those who provide their personal information through the website.

Below, we explain your data protection rights and how you can exercise them.

In accordance with the current data protection law, you are entitled to:

  • ACCESS: to obtain confirmation of the existence of personal information and request a written copy of the above that FAINCA HR may have in its power;
  • CORRECTION: to correct information stored about you if it is not accurate. If the information that we store needs updating, or if you think that it may be erroneous;
  • DELETION: to block, remove or delete personal data that we have about you;
  • PORTABILITY: to receive your personal data, which you have provided to us, in a structured, commonly use format which can be electronically read to report them to another data controller;
  • OBJECTION: to withdraw your consent when appropriate, without affecting the legality of the processing according to your consent before the cancellation; or alternatively to object to your data being used for commercial activities and other promotional activities, as indicated in the previous section, “How do we use your personal data for commercial purposes?” and
  • LIMITATION: to restrict the processing we carry out in connection with your personal data.
  • These rights may only be exercised in certain circumstances such as:
    • When you report the inaccuracy of your personal data to us during the period that we need to verify their accuracy;
    • When the processing is unlawful and you want us to delete your personal data;
    • When you have objected to any processing that FAINCA HR performs based on legitimate interest, during the period that we need to verify that your right takes precedence over this interest;
    • When FAINCA HR no longer needs your personal data for processing purposes, but you need them to make, exercise and defend claims;
  • Submit a claim to a control authority (aepd.es), in particular in the Member State of your normal residence, place of work or place of the alleged violation, if you consider that the processing of your personal data is not in accordance with the current regulations.

Purposes and Processing.

Legal standing

The processing of the data is legitimized according to the GDPR (EU) 2016/679 as it is necessary for the implementation of the contractual or pre-contractual relationship, in this case, for the conclusion of the purchase of products in the FAINCA HR (www.faincahr.es)

Should FAINCA HR be authorized for sending electronic promotional commercial communications, the legitimating basis will be the user’s consent.

Purposes

The collection and processing of your personal data through the registration form on the website is intended to enable the management of your registration as a user for the products and the management of possible inquiries to the Customer Service Department.

On the other hand, the user may authorize FAINCA HR for processing his/her data with the purpose of sending electronic commercial promotional communications, including communications via email, mail or phone.

Also, the user may at any time revoke the consent given for the processing of his/her data for sending commercial communications, using any of the two means expressed in this privacy policy.

In addition to the information provided by the user, the IP address is also processed in order to identify the terminal from which the information is entered and obtain the geographical location of the user.

Data storage

Your data will be stored for the duration of the administrative, accounting and/or commercial relationship of the interested party with FAINCA HR, plus the time limit lay down by the specific legislation in which these data may be required.

In case the user exercises his/her rights of erasure and objection, his/her data will be blocked and confidentially destroyed subsequently.

Data recipients

The recipients of the information are the third parties in charge of processing that provide a service to FAINCA HR in the shipment of the products purchased by the user or the information, with whom the corresponding agreement has been signed that guarantees compliance with the GDPR and the appropriate security measures.

  1. COMPULSORY OR OPTIONAL CHARACTER OF THE INFORMATION PROVIDED BY THE USER

 

Users, by marking the corresponding boxes and entering data in the fields, contact forms or submitted in download forms, expressly and freely and unequivocally accept that their data is necessary to meet your request, for part of the provider, being voluntary the inclusion of data in the remaining fields. The User guarantees that the personal data provided to FAINCA HR is true and is responsible for communicating any modification thereof.

 

FAINCA HR informs and expressly guarantees users that their personal data will not be transferred in any case to third parties, and that whenever they make any kind of transfer of personal data, the express, informed and unequivocal consent of the Users will be requested in advance. All data requested through the website are mandatory, as they are necessary for the provision of an optimal service to the User. In case all the data are not provided, it is not guaranteed that the information and services provided will be completely adjusted to your needs.
